Under California law, almost any form of domestic violence is a criminal act. Criminal code section 273.5 defines criminal penalties including jail or prison and participation in a year-long batterer's treatment program.

Domestic Violence is not just striking another person. Abusive actions can include kicking, shoving, pushing, pulling of hair, throwing objects, frightening or stalking the victim, or restraining the victim from freely coming and going from a location.
Prior to the mid-1980's, most local authorities could not legally make an arrest without a warrent unless a misdemeanor occurred in the police officer's presence, or the officer had a likely reason to think that a felony had been committed. Since most domestic violence cases involve simple assault and battery, which would be considered a misdemeanor, the police usually could not make an arrest at the scene. Advising the husband or boyfriend to "take a walk around the block" was often the extent of police intervention and the best they could do. All 50 states now permit "warrantless" arrests in domestic violence cases.

PC 273.5 (a) - Any person who willfully inflicts upon a person who is his or her spouse, former spouse, cohabitant, former cohabitant, or the mother or father of his or her child, corporal injury resulting in a traumatic condition, is guilty of a felony, and upon conviction thereof shall be punished by imprisonment in the state prison for two, three, or four years, or in a county jail for not more than one year, or by a fine of up to six thousand dollars ($6,000) or by both that fine and imprisonment.
